UPDATE TO URGENT ACTION ALERT - December 10, 2004

House Bill 6272 was on the fast track and term-limited Rep Tabor thought she had it all wrapped up in the lame duck session, but thanks to all of you who made calls, sent emails, and met in person with your legislators, the controversial bill lost momentum the last week of session and died in the Senate committee.  We hear Susan Tabor is furious.  It will be important to watch next year for another attempt at this deceptive and underhanded scheme.

Smoke and mirrors! Term-limited Rep Tabor is trying to misrepresent House Bill 6272 as something that "would allow" the DNR & NRC to promote legislation to reclassify non-game species as game. However, those agencies can already do that -- provided that they don't break the law again.

Background: The Natural Resources Commission, with the assistance of the Department of Natural Resources, bypassed the legislature, ignored significant public opposition, and illegally established a mourning dove shooting season in Michigan.  Due to the blatant violation of public trust, the courts [1985] issued issued an injunction against the DNR and NRC which prevented them specifically from "promoting an open season on mourning doves."  This injunction was in place to protect the peoples' interests and the it was lifted when Governor Granholm broke her campaign promise and signed the dove shooting bill into law.

Important to note: the DNR and NRC continued to disregard the law by violating the injunction several times when it was in place, over several years of failed attempts to re-classify the dove as a game species.

There are no other injunctions in place at this time that would "prevent" the DNR or NRC from lobbying to place any other non-game species on the game list.  If however, the DNR and NRC chooses to overstep its authority again and illegally establish a shooting season on another protected non-game species, we presently we have the courts to reprimand them.  HB 6272 - among other things - would interfere with the courts ability to enforce the law which protects the peoples' interests.

Tabor's lame duck agenda is to change the "mission" of the DNR and NRC from managing wildlife held in trust to arbitrarily mandating and directing the agencies to promote the re-classification of every protected non-game species possible to the game list in order to establish new seasons on them.  48 other states do not permit this kind of ungoverned dictatorial power and this bill is directly intended to unfairly influence the legislature, the courts, and manipulate the outcome of BALLOT ISSUES.

This bill, as introduced, would change the "mission" of the DNR and NRC from managing wildlife held in trust for the people of the State of Michigan, to arbitrarily mandating and directing the agencies to promote the re-classification of every protected non-game animal possible to the game list in order to establish open hunting seasons on them.  Forty eight other states do not permit this kind of ungoverned dictatorial power and this bill is directly intended to unfairly influence the legislature, the courts, and manipulate the outcome of BALLOT ISSUES.

The integrity of Sec 40110 of PA 451 [MCL.324.40110] is what protects your voice through legislative representation.  Due to the fact the bill has several directions it can go from here (with amendments), the bill's sponsors will try to take it as far as they can (their ultimate goal of removing legislative authority - now or through successive "steps").  The DNR and NRC can already support, oppose, and lobby legislation -- they have full time staff of paid lobbyists who actively work the legislature and legislation.  But among other things, this change in mission will open the door for the DNR to gain access to state funds to launch an overpowering fight against our citizen referendum on HB 5029 in a more direct and public way -- including state paid commercials to attempt to change or confuse public opinion on the mourning dove shooting issue.  See how private groups did this in Ohio here.

ACTION ALERT, LAME DUCK THREAT TO DOVE REFERENDUM - November 8, 2004

Here we go again: For the lame duck session, Rep. Susan Tabor [D-71] and her cronies (see co-sponsors here) introduced House Bill 6272. 

HB 6272, as introduced, would change the "mission" of the DNR and NRC from managing wildlife held in trust with input from the public through their legislators, to arbitrarily mandating and directing the agencies to promote the re-classification of every protected non-game animal possible to the game list in order to establish open seasons on them.

Buried within misleading buzz words, such as "preserve and promote the heritage," is a direct threat to ALL protected non-game species. By design, this bill will be used to unfairly manipulate the system and "stack the deck" in the legislature, the courts, and ON BALLOT ISSUES that protect the peoples' constitutional rights to participate in the decision making process.

This bill -- including future planned amendments -- is extremely dangerous in many ways with far reaching repercussions (see additional talking points here).  It would effectively remove both the democratic process and protections currently afforded the people of the state of Michigan pertaining to wildlife issues.  In short, HB 6272 is a spin-off of the section [Sec 40110] in HB 5029 that was removed in committee regarding legislative authority  --  this was done as a calculated plan to use political sleight of hand tricks and dirty politics to undermine the statewide ballot referendum in the lame duck session. 

The Sandhill Crane is targeted as an immediate "next."  Dove and crane shooting proponents smack their lips as they trivialize this magnificent species as "big, noisy, tasty birds that fly fast and make great targets."

DOVE BILL UPDATE - June 18, 2004

UPDATE: On June 18, 2004, Governor Jennifer M. Granholm SIGNED the bill to remove the protected songbird status and allow the shooting of mourning doves in Michigan. Her sad choice to serve a fringe faction has betrayed voters and she knowingly has ignored the majority of Michigan citizens. Contrary to any "compromise or trial spin" she may attempt to put on it, the technically flawed and purposefully divisive Act (PA 160) opens the entire state of Michigan to dove "hunting" - indefinitely.

Before the Governor signed the dove bill, 14,522 citizens had contacted the governor's office and asked her to veto, 7,150 asked her to sign it. The Songbird Protection Coalition had also sent 10,000+ petition signatures, more than twice as many as dove shooting proponents could provide. Hundreds - and hundreds - of letters to the editor were published in newspapers across the state favoring the continued protection of the mourning dove as a songbird. Every poll conducted in Michigan, recently and historically, confirmed the majority opposed the change in public policy. See more here.

The voice of the people has been ignored and was shamefully not represented by the Michigan Legislature. This bill will go to the House to concur changes and then be sent to the Governor.

The pre-election promise by Jennifer Granholm was to solidly veto ANY legislation that would allow the shooting of the mourning dove in Michigan. Several statewide newspapersÝ have recently quoted Granholm's office as saying "unless lawmakers put the question on the November ballot, Gov. Granholm will veto it." The Governor needs to uphold her promise to the people of the state of Michigan and solidly VETO HB 5029!

HB 5029 was reported out of the Senate Judiciary Committee today and has been referred to the full Senate for 2nd reading status to be immediately scheduled for floor vote - probably tomorrow.

Changes to the bill:

  • The $350,000 appropriation was removed.
  • A $2 stamp was added: $1 to go to game hunting fund, $1 to go to non-game fund.
  • At this time, the referendum language was not added. Senate Majority Leader Ken Sikkema opposes a vote by the people on the issue so we do not expect this amendment to be added.

UPDATE TO DOVE BILL HEARING - February 17, 2004

The dove bill STALLED Tuesday in the state Senate Judiciary Committee because the votes weren't there to pass it that day. As a seven member committee, four votes are required to move the bill through to the floor of the Senate for full vote. In a surprising turn of events, Senator Bruce Patterson (R-Canton) - who is an attorney, avid hunter, and supports dove hunting in Michigan - voiced sound objections as to how the integrity of the system was being unjustifiably manipulated by the bill's proponents beyond reasonable boundaries.

Leadership continues to have "lots" of time to waste on the shooting of Michigan's Bird of Peace. Backers of the bill promised more "manipulation" to bring it to a vote of the full Senate next week. Bill Nowling, spokesman for Senate Majority Leader Ken Sikkema (R-Wyoming), said he expects a renewed effort to send a version of the bill to the Senate floor for a vote next week.

We will keep you as informed as possible on the timeline for this bill. However, given the "tactics" used thus far, the public may receive little or possibly no notice.

URGENT ACTION ALERT - February 12, 2004

The Republican controlled Senate "anonymously" took a voice vote on February 12th to pull the dove bill away from Senate Appropriation Committee (the correct committee by policy standards) and referred it to the Senate Judiciary Committee (which handles criminal law and procedure). This is a totally non germane committee and HB 5029 has been deliberately "switched" and placed squarely in the hands of a committee, who's chair (Senator Cropsey, R-33) is known to be pushing the shooting of doves in Michigan. Senate Republican Majority Leader Ken Sikkema initially didn't allow this political maneuver because it violated legislative policy. However, it is one dirty trick after another with the dove bill and Sikkema is assisting proponents and "required" cancellation of the Senate Appropriation Committee hearing scheduled for Thursday, February 5th.

The Judiciary Committee will hold a hearing on the dove bill Tuesday, Feb. 17 at 12:00 noon. "Testimony" has been reduced to "invitation only" to block the majority of citizens who oppose the shooting of doves. We can expect the bill to immediately hit the Senate floor for vote if it passes this committee. YOU MAY STILL ATTEND THE HEARING AND PLEASE DO! More info here.

"IT'S NOW OR NEVER (OR NOT FOR A REALLY LONG TIME) TO PASS THE DOVE BILL! HB 5029 the bill to establish a dove season will be voted on next Thursday, February 5 by the Senate Appropriations Committee. This a very close vote!!! Please contact your Senator and ask for their support for the bill. I can assure that the opponents of the bill will be making calls by the hundreds over the next week trying to sway just a few votes
which is all that it will take to defeat this bill."

2/4/04, 4pm -- UPDATE TO THIS ALERT: After being "required" to make HB 5029 a top legislative priority and immediately schedule it ahead of more important matters facing the people of the state, the Senate Appropriation Committee has now had to cancel the hearing at the "11th hour."

It appears that dove shooting proponents are continuing their shameful campaign to block of the voters voice. They were worried that the $350,000 appropriation would have been removed in committee, thus allowing the people of the state of Michigan a voice in the ballot box. Additionally, they want to block an environmental amendment that would have banned the use of toxic lead shot and required steel shot.

Keep up your hard work. YOU are making a difference if those who would shoot this songbird had to resort to such measures and tactics. Will keep you posted on what happens next. We have to wait and see.

URGENT ACTION ALERT DECEMBER 2003- JANUARY 2004

Despite Senator Sikkema's "declaration" to the press that the dove bill would be put on hold until more important matters are taken up (like the 920 million dollar state budget crisis)...he has now bowed to radical interest groups and made the shooting of the mourning dove, Michigan's bird of peace,  the number one priority for the Senate - it will be forced to be heard in a committee and pushed immediately to the floor for vote.

12/19/03 -- UPDATE TO THIS ALERT: Dove-shooting proponents aggressively pushed hard in a heavy-handed organized manner, using every backdoor underhanded tactic in the book to quickly and quietly force the dove bill through the Senate before the holiday break. Thanks to the dedicated hard work of every single person who participates - YOU - the citizens of Michigan pushed back in a majority force. Senator Shirley Johnson pushed back as a key leader and committee chair in the Senate (she deserves your thanks and gratitude!).

WE MUST REMAIN DILIGENT -- THIS IS HARD FOUGHT AND THE VOTES ARE CLOSE.

This bill will now probably be heard in committee sometime in January (due to continued pressure from some in the Republican leadership to make this a top priority). The radical fringe element continue to work over senators with propaganda and veiled threats.

URGENT ACTION ALERT UPDATE - October 23, 2003

The dove bill is scheduled for hearing on Wednesday, Oct. 29th and will be immediately voted on in the House on Tuesday, Nov. 4th.

Representative Tabor, chair of the House Conservation and Outdoor Recreation Committee, intends to hold a "stacked" hearing on October 29th on HB 5029.  The hearing, however, has been reduced to a "technical formality" since Tabor has confirmed that the bill will be put to a House vote on November 4th, the same date she coordinated weeks ago with radical out-of-state interest groups to hold a "rally" at the Capitol to push the dove bill under the guise of expanding "hunter rights."

Tabor has kept this committee schedule secret and only four days ago told a reporter [Kurt Madden of the Community News] that absolutely "no timetable exists for it to be reported to the House" for vote. This of course was not true and she has kept this long-planned date off the official committee calendar and quiet as long as possible, to gain advantage and avoid concerned citizen input and participation.

ACTION ALERT August 2003:

Mourning Dove hunting legislation introduced in the Michigan Legislature.

On August 13, 2003, House Bill 5029 was introduced by State Representative Susan Tabor [R-71]. This bill attempts to remove the mourning dove as protected songbird in Michigan and list it as a game species in order to create a new shooting season. Tabor's plan to create a voting block through the new caucus has come into play.

Protected since 1905, Michigan has maintained a long heritage and tradition of mourning dove protection because the majority of citizens, including the majority of Michigan hunters, overwhelmingly oppose the hunting of doves in Michigan.

Also within this legislation is a section to repeal MCL 324.40110. This is the law that protects YOUR RIGHT direct accountable legislative authority - which allows the majority's voice to effectively be heard to protect all traditional non-game species. The authority to "DESIGNATE" a non-game species species as "game" would be transferred over to the non-elected Natural Resource Commission...a commission that has violated the law and court order several times to attempt to "take" the dove from the people of the state of Michigan. 

This is not wanted by the people and is being pushed by out-of-state dove-shooting proponents.

WHAT YOU CAN DO:

YOUR help is URGENTLY needed, many NEW legislators need to be educated about the hotly contested dove issue...

Call, write, fax, or email your State Representative and State Senator TODAY (sample letter and fact sheet). Urge them to oppose HB 5029. Make it clear you do not want recreational hunting "management" used on this protected songbird and you do not want your right to legislative authority repealed!

Call the House at 517-373-0135 and ask to be connected with your Representative.

BILL STATUS:  Referred to Conservation and Outdoor Recreation Committee, the committee Tabor chairs.
House leadership is gearing up for a vote late October/early November on doves.
